investigation have been acquitted after a judge rejected
English-speaking police officers’ identification of who was talking
with foreign accents in secret recordings of a large-scale drug
conspiracy.
The case highlights the frailties of “earwitness evidence” and
cross-racial investigations of crime.
It started in July 2019 with information that a man in Vaughan, north
of Toronto, was selling fentanyl.
A special multi-force anti-organized crime unit called the Combined
Forces Special Enforcement Unit began an investigation, codenamed
Project OSwordtail, with the prefix O meaning it is an Ontario-based
RCMP investigation.
After a year of undercover infiltration, video surveillance,
wiretapped phone calls and a hidden microphone in a warehouse,
officers in and around Toronto moved in for arrests and searches of
homes and businesses.
In the August 2020 announcement, police said they busted criminal
groups involved in importation, exportation and distribution of
cocaine, fentanyl, heroin, opium and ketamine. More than 35 kilograms
of cocaine and five kilograms of fentanyl, heroin, and opium were
seized, along with three vehicles with hidden compartments.
Prosecuting John Palumbo, the Vaughan man who was the first focus of
the probe, was easy. It was his cellphone and warehouse in Vaughan
that were wiretapped by police. He sold a kilo of cocaine to an
undercover officer for $76,000 and arranged to sell 30 kilos more,
court heard. He quickly pleaded guilty to trafficking cocaine and
possessing proceeds of crime.
Palumbo had told an undercover cop he was getting the cocaine from his
“guy” and he made those arrangements independent of the officer.
That made figuring out who his “guy” was the tricky part.
Police alleged it was Ravi Shanker, who operated a liquidation
business in Brampton, court heard. Police alleged he plotted drug
sales with Havinder Singh and Sukhsimrat Pawar. All three men were
charged with conspiracy to traffic cocaine and trafficking cocaine.
Wiretap recordings of Palumbo speaking on his phone and at meetings in
his warehouse were played in court.
A hidden camera outside the front of Palumbo’s warehouse recorded
people coming and going. Shanker, Singh, and Pawar were among the
people visiting the facility. They didn’t deny they came and went, but
the video didn’t record any drug transactions.
The primary evidence of the identity of Palumbo’s supplier was
captured only on audio recordings and required voice identification of
the person talking.
Police testified they were sure it was Shanker.
“Some of the pitfalls in the use of electronic audio techniques as
means of generating audio identity evidence are under scrutiny
particularly, in this case, as they concern English-speaking officers
seeking to identify crime suspects speaking with foreign accents
unfamiliar to the officers,” Judge Beth Allen wrote in her Ontario
Superior Court of Justice decision released Oct. 13.

Peel Police say they had developed a safety plan for the victim after he received and reported a death threat they confirm earlier this year the RCMP removed a Range Rover from that address. Video also shows an attack on a Indo radio personality he strikes a fighting pose then runs and is hit by the masked Indo. CTV National News has run the story many times in 48 hours.
There have been 3 alleged attacks on Indo media types in Brampton and not one arrest.

ONTARIO’S Peel Regional Police investigators from the Fraud Bureau have arrested and charged a Mississauga lawyer, Shahid Malik, who is alleged to have defrauded victims related to real estate transactions resulting in losses in excess of $10 million dollars.
Between June and December 2021, numerous victims retained the services of Malik, the owner/operator of Shahid Malik Law Office located in Mississauga, to settle their real estate transactions.
It is alleged that Malik received millions of dollars in trust for real estate transactions to allow the victims to pay off their outstanding mortgages. It is further alleged that despite the victims’ numerous requests, Malik did not allocate these funds towards the outstanding mortgages. As such, each victim has suffered a significant financial loss.
On Wednesday, August 24, Shahid Malik, 41, from Brampton, was arrested on the strength of an outstanding warrant at Pearson International Airport upon returning to Canada. He has been charged with ‘defraud the public’ and ‘breach of trust.’
He appeared at the Ontario Court of Justice in Brampton and was held pending a bail hearing scheduled for August 25.
“Mr. Malik used his position of trust to defraud a substantial amount of money from hard-working people in our community. This investigation and arrest demonstrated our commitment to pursuing offenders, preventing further victimization and the value of collaboration with the Canada Border Service Agency,” said Superintendent Hubie Hiltz.

The day after he resigned, Brown was succeeded on an interim basis by Nipissing MPP Vic Fedeli.[60] Fedeli, who was unanimously elected by caucus, asked Brown to take a leave of absence from Queen's Park while he defended himself against the allegations. In addition, Fedeli announced that he would not sign Brown's nomination papers if he attempted to run in a Barrie riding at the June 7 provincial election. Brown had intended on running in Barrie—Springwater—Oro-Medonte in that election, but Fedeli's announcement would mean that he would have to run as an independent.[61]
In one incident, there was an allegation that Brown exposed himself to a teenager and asked her to engage in oral sex after plying her with alcohol. The accuser alleged that she was an 18-year-old high school student when the oral sex incident occurred; but on February 13, three weeks after the first public report, she amended her claim to say she was a year older than she had previously maintained, and was therefore over the legal drinking age. Corrections were subsequently made on the initial news articles.[62] In the other incident, Brown was alleged to have kissed, without consent, a female aide in his employ while in his bedroom.[63] Brown later took a lie detector test and claimed that he felt his name was cleared.[70] No charges were laid as a result of either alleged incident and on April 23, 2018, he sued CTV for $8 million in damages.[71][72] He then entered the Ontario PC leadership race less than one or two hours before the deadline.[66][73]
In March 2022, Brown and CTV reached a settlement, where CTV expressed "regrets" over the incorrect reporting of certain details in the article; no money was paid out to Brown by CTV as part of the settlement.[74]
Expulsion from PC caucus and brief second run for the leadership
Brown was ejected from the PC caucus on February 16, 2018, following reports that he was claiming he hadn't actually resigned as party leader and a series of Facebook posts in which he attacked the credibility of his accusers.[1] Later that same day, Brown registered as a candidate for the Progressive Conservative leadership election, pending approval from the party,[75] and on February 21, after being vetted, Brown was given the "green light" by the PC Party to run for the leadership.[76]
Brown officially launched his second leadership campaign on February 18 with a rally in Mississauga.[77]
On February 20, PC MPP Randy Hillier filed complaints to the Ontario integrity commissioner alleging that Brown had breached the province's ethics rules around down payments over his 2016 purchase of a $2.3 million waterfront house on Lake Simcoe, a loan from a friend and undeclared travels.[78] The house was listed for sale in 2018.[79] On April 28, 2018, a 60-page report by the commissioner found out that Brown breached the Member's Integrity Act four times over matters involving his personal finances, but there was insufficient evidence to find him in breach over alleged travel violations.[80]
Brown withdrew his candidacy for party leadership on February 26, 2018, citing the difficulties of simultaneously running for leader while fighting against allegations against him. His withdrawal came days after the revelation that the integrity commissioner was investigating Brown for alleged financial improprieties and several hours after a report revealing his apparent interference, while he was leader, in a Tory candidate nomination that is then being investigated by Hamilton Police for fraud.[citation needed][needs update] Brown's supporters cited harassment against members of his family as one cause of his decision to withdraw.[81] Brown's $100,000 registration fee was not refunded by the party.[82]
After the election of Doug Ford as the new leader, there were rumors that Brown would not be allowed to run under their banner.[83]
Departure from provincial politics
The Progressive Conservative Party's nomination committee unanimously ruled on March 15, 2018, that Patrick Brown would not be eligible to run as a PC candidate in Barrie—Springwater—Oro-Medonte for the June 7, 2018 election.[84] Brown announced on Twitter shortly afterward that he would not run as an independent candidate in Barrie—Springwater—Oro-Medonte.[85] It was later reported by the National Post that a Snover Dhillon, a convicted fraudster banned by the federal Conservatives, played a role in all those nomination irregularities.[86] Following his departure from provincial politics, Brown restarted his law practice and accepted a job as vice-president of a telecommunications company in Vaughan.[79]
Mayor of Brampton (2018–present)
Campaign
According to reports by the National Post Brown was "urged" by supporters to run for Chair of the Regional Municipality of Peel in the 2018 Peel Region municipal elections, the first in which the position is directly elected.[87] Brown registered his candidacy for regional chair on July 3, 2018.[88] On July 27, 2018, Brown registered his candidacy for the Brampton mayoral election following Premier Doug Ford's announcement that regional chair elections in Peel Region would be cancelled.[3] Incumbent Brampton mayor Linda Jeffrey suggested "that Brown jumped into the race, and city, at the last minute in a bid to 'rehabilitate' his career", while Brown suggested that Jeffrey's "lack of leadership has contributed to rising property taxes and shootings" in the city.[89]
Brown's platform includes a "poverty action plan" that would require a minimum percentage of new housing to meet affordable standards, and rental properties being redeveloped to include equal amounts of rental spots before and after the process.[90] His "Public Safety Initiative" would include more front line police officers, strengthening the mental health program, and affordable recreation for youth.[91]
Brown defeated incumbent Linda Jeffrey by a narrow margin on October 22, 2018. In his acceptance speech, he thanked former Ontario premier Bill Davis for his endorsement and said, "I’ve got so much hope in my heart for what’s ahead for Brampton. You know why? I know we can turn this around, I know Brampton is going to be back, Brampton is going to become an economic engine".[92] According to the Toronto Star, Jeffrey had the backing of "PC party operatives — Doug Ford’s campaign manager organized a fundraiser for her".[93]
Fair Deal for Brampton Campaign
In June 2019, Brown and Brampton City Council launched a public pressure campaign demanding greater healthcare funding from the provincial government.[94] In this campaign, city council asked citizens of Brampton to sign a petition and share their healthcare stories with the #FairDealforBrampton hashtag.[95] In a media release, the City of Brampton highlighted that residents receive $1,000 less in healthcare funding per person than the provincial average, that there are 55 per cent fewer hospital beds than other Ontario municipalities, and there are unmatched increases in funding compared to the exponential growth of Brampton each year.[95]
The three demands of the provincial government highlighted by city council within the Fair Deal for Brampton campaign included: immediate funding to Brampton Civic Hospital and Peel Memorial Centre to support the increasing demand from the community, arranging fund for the completion of Phase 2 at the Peel Memorial Centre and constructing a new healthcare facility for Brampton to meet the needs of the growing population.[95]
On January 22, 2020, Brampton City Council declared a unanimous healthcare emergency for the City of Brampton. With data from William Osler Health System indicating a hospital occupancy rate consistently over 100 per cent over 2019. The motion called on the provincial government to provide funding for Brampton Civic Hospital and Peel Memorial Centre and to assist in moving ahead with the Phase 2 expansion of 850 beds at Peel Memorial Centre.[96]
On January 24, 2020, the provincial government committed to the funding of a new hospital in Brampton. In a statement to the Brampton Guardian, Brown said “I recognize the fact that the crisis we’re in wasn’t created in a year. That this has been a crisis that has emerged over the last 15 to 20 years and the fact that we’re at the table talking to the premier directly about it when only two days ago we had our physicians and patients come forward with a plea for help.”[97]

"In recent weeks, our Party became aware of serious allegations of wrongdoing by the Patrick Brown campaign that appear to violate the financial provisions of the Canada Elections Act. Following our Rules and Procedures for the 2022 Leadership, the Chief Returning Officer notified the Patrick Brown campaign of the allegations and asked for a written response. He also withheld the interim membership list from the Patrick Brown campaign.
“The information provided to date by the Patrick Brown campaign did not satisfy concerns about their compliance with our Rules and Procedures and/or the Canada Elections Act. The Chief Returning Officer has therefore recommended to LEOC that LEOC disqualify Patrick Brown and earlier tonight LEOC agreed to do so. The Party will be sharing the information it has gathered with Elections Canada, who is responsible for ensuring compliance with, and enforcement of, the Canada Elections Act.
"Throughout the investigation into these allegations, the Chief Returning Officer and I have done our best to be fair to the Patrick Brown leadership campaign and provide them with the time they need to substantively refute these allegations. We regret having to take these steps but we have an obligation to ensure that both our Party's Rules and federal law are respected by all candidates and campaign teams. None of these problems has any impact on the integrity of the vote itself.

Maple Ridge RCMP will not pursue charges after councillor suprises intruder in home renovation

Maple Ridge city Councillor Ahmed Yousef delivered an alleged thief to the RCMP after a citizen’s arrest at his home.
Now he wants to ensure the culprit faces justice, but police say they are not considering charges.
Yousef’s home is undergoing extensive renovations, but he has secured the site with a high metal fence.
Still, he noticed earlier this month that someone had gone into his garden shed and stolen a hedge trimmer, as well as its batteries and charger. He put a new padlock and bolt on the shed door.
Later, he noticed the newly installed lock had been broken, leaving the shed insecure. He searched and found nothing obviously missing, but suspected the culprit might be planning to return later to make a bigger haul.
At about noon on Nov. 8, Yousef was downstairs in the home when he heard footsteps. Someone was moving around on the main floor of his house. He surprised the intruder at his back door.
“That’s when I confronted him. I acted very swiftly to restrain him on the ground,” he said.
He said the perpetrator had a pair of bolt cutters, but did not appear to have a weapon. The perp was the larger man, but Yousef had self-defence training, and kept him on the ground.
He called the police to report a citizen’s arrest.
Yousef took photos of the culprit’s face, and of his BC Services Card – revealing a 30-year-old Maple Ridge resident. The intruder had three duffle bags – one he was carrying, one he left in the house, and one near his bike, outside the fence. Yousef did not get a chance to look into them before police arrived.
The arresting officer was pleased to find the culprit still there, and told the city councillor that in most cases of citizen’s arrest, the perpetrators have left the scene by the time police arrive.

Yousef said he heard the officer place the man under arrest for breaking and entering.
However, the episode did not end to the satisfaction of the councillor, because the officer released the man from the scene.
“He got out of the police cruiser, got on his bike, and rode off,” said Yousef.
Now he hopes there will be charges, and plans to press the issue.
“Obviously he was in my house uninvited,” Yousef said.
The entire situation could have been much worse, if one of his more vulnerable family members had been at the house, he asserts.
“There was potential for this to go very badly, very quickly.”
Not charging the intruder would send the wrong message, Yousef said.
“We’re teaching them that if you’re down and out, feel free to break into people’s homes and steal,” he said. “We need equal and consistent application of the law.”
Police are not considering charges at this time, calling the man a “squatter at an insecure, partially torn down residence.”
“Police were contacted by the owner of the property who located the unknown person on their property,” said Cpl. Julie Klaussner. “Police attended and the person was removed without incident. This investigation is concluded and charges are not being considered at this time.”
Informed about the police statement, Yousef called it disappointing, but said he plans to urge police to charge the man he apprehended.
“The officer was, you know, very realistic in tempering my expectations by telling me that most probably Crown counsel will not pursue charges,” Yousef said.
“I was baffled as, again, per the Criminal Code, this is the definition of breaking and entering. But he was released on scene. The person was able to get onto his bicycle and ride away from my front door.”
Yousef said he was extremely disappointed to see that happen.
“I came to Canada in 2010 with my family so we can live in a country that all obeys and respects the rule of law, where laws are equally and consistently applied to citizens, unlike many of the other countries where I lived, where your socioeconomic status or the family that you come from determine whether you’re able to be prosecuted or not,” he said. “And to see this happening right here in my neighbourhood at my home was again severely disappointing.”

Rob Dhanu, co-founder of the Dhanu Dhaliwal Law Group, and a former Crown prosecutor told Global News that police and Crown are always going to consider two factors when it comes to charging someone.
“The first factor is whether they have enough evidence to successfully prove the offence,” Dhanu said. “If it were able to go to trial in a court of law.
“The second factor that police and Crown are going to consider is whether it’s in the public interest to prosecute this individual. Here’s where it gets a little more grey or perhaps even a lot more grey.”
Dhanu explained that in this case there is no way to prove the suspect cut the lock on Yousef’s shed and it could have been cut by someone else. (Greg: Yup.)
Second, Dhanu said it appears this person did not actually take anything from Yousef’s property.
“So at this stage, the officer’s thinking, ‘How serious is this crime, then?’ If we’re missing those two factors, I may be able to prove the B&E, but it may not be as serious as it ought to be for me to actually take this thing to court.”
Dhanu said he understands Yousef’s frustration but it doesn’t mean the officer made the wrong decision.
“They have to determine which crimes are most serious, which crimes that they ought to pursue to the end,” he added. “And if that means going to trial, they should take it to that stage.
“We don’t want officers who don’t use their discretion and just arrest everyone.”
In a statement, Ridge Meadows RCMP said police are not considering charges at this time against the suspect.
“Police were contacted by the owner of the property who located the unknown person on their property. Police attended and the person was removed without incident,” the statement read.
“This investigation is concluded and charges are not being considered at this time.”
Yousef is frustrated by the entire experience and said it speaks to B.C.’s justice system as a whole.
“The dysfunction of that system, the fact that we no longer have deterrence against criminal activity, the fact that we’re rewarding bad behaviour by allowing someone to break into someone’s house, possibly, allegedly stealing some property and then being able to go home,” he said.
“At the end of the day, his identity is protected. You can’t show his face, you can’t tell his name. But yet my name and my face are out there. So who are we serving, the victim or the criminal, ultimately?”
He said he would like to see more criminals prosecuted for their crimes, regardless of whether they threaten people or property.
“We need to have that deterrent. We need to have restorative justice so people are held accountable. We need to have equal and consistent application of the law,” he said.
